Virginia Divorce Grounds & Residency Requirements

Before filing for divorce in Fairfax County, at least one spouse must have been a bona fide Virginia resident for six months under Va. Code § 20-97. The grounds you file under determine how long the process takes.

Virginia’s no-fault divorce requires a separation period. When spouses have no minor children and a written property settlement agreement is in place, that period is six months. When minor children are involved or no agreement exists, the required separation is one year. Virginia doesn’t recognize a formal legal separation status; the clock starts when spouses begin living separate and apart with the intent that the marriage is over.

Virginia also recognizes fault-based grounds under Va. Code §§ 20-91 and 20-95, including adultery, cruelty or reasonable apprehension of bodily harm, willful desertion or abandonment, and felony conviction with incarceration exceeding one year. Adultery and felony conviction carry no mandatory waiting period, allowing a spouse to proceed without completing the no-fault separation period. Cruelty, reasonable apprehension of bodily hurt, and willful desertion or abandonment still require one year from the date of the act before a final decree may be entered. Proven fault can also affect spousal support determinations, which makes the choice of grounds a strategic decision worth discussing before filing.
